Scope and Contents

The Members appointed to the 1983-1984 Special Investigative Lottery Fund Task Force (HR 238) were led by Gerard A. Kosinski (D), Chairman. Other members included Jeffery W. Coy (D), David W. Sweet (D), Walter F. DeVerter (R), and Harold F. Mowry, Jr. (R). A total of five public hearings were held by the Task Force, however the first hearing was only to appoint the two staff members, Diana Sacks as General Counsel and Steven Zemenick as the Research Assistant. During other hearings, the Members listened to testimony from Lottery officials, the Department of Insurance, and the Department of Revenue, among others. The Task Force found that the safety of the Lottery's investments for prizewinners should be the primary consideration of the investors, and that the policies of the Lottery Fund had been inadequate. The inadequacy of the regulations led to one insurance company, the Capitol Life Insurance Company, to acquire nearly forty percent of all the Lottery's annuity business, even though its financial situation was unstable. The Task Force felt that the standards outlined for insurance companies to qualify for bids on annuity contracts were so outdated that it was possible for failing insurance companies to apply for contracts, and endanger the financial security of the Lottery Fund and its prizewinners. The Task Force believed that there were alternative investment vehicles which could be easily adopted by the Lottery Fund and offered greater security to prizewinners. The tendency was to place yield over financial safety when considering investments, however the Task Force felt that the sales of Lottery tickets would not be negatively affected by lower jackpots that offered higher security. The Final Report of the Special Investigative Lottery Fund Task Force was submitted to the General Assembly on November 30, 1984.
